Rubbish Removal Chiswick Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Chiswick provides rubbish removal and waste collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Rubbish Removal Chiswick.

If you do not agree to these Terms and Conditions, you should not make a booking or use our services.

Scope of Services

We provide rubbish removal and waste collection services, which may include loading items from your premises, transporting them, and arranging for lawful disposal or recycling at licensed facilities. The exact scope of each service, including the nature and volume of waste, access requirements and any special instructions, will be agreed with you at the time of booking or upon arrival following any on-site assessment.

Our services are intended for lawful waste only. We reserve the right to refuse to collect or handle any items that we consider unsafe, illegal, hazardous, unsuitable for standard removal, or beyond the agreed scope.

Booking Process

You can request a quotation or make a booking by contacting us through our published communication channels. To provide an accurate quote and confirm availability, we may ask for information about the type and approximate volume of waste, the location, access arrangements, parking availability and any other relevant details.

Any quotation we provide before viewing the waste is an estimate only, based on the information you supply. This estimate is subject to change after an on-site assessment, when our team can confirm the volume, weight and nature of the waste and assess any access or safety issues.

A booking is only confirmed when we accept your request and provide you with a time and date for the service. We may confirm this verbally, in writing or electronically. We reserve the right to refuse any booking at our discretion.

You are responsible for ensuring that all information you provide during the booking process is accurate and complete. If the information is inaccurate or incomplete, the price, duration and feasibility of the service may change, and we may charge additional fees or, in serious cases, refuse to carry out the work.

Service Access and Customer Responsibilities

You must ensure that our team has safe, reasonable and lawful access to your premises at the agreed time. This includes arranging suitable parking, informing us of any restrictions, and ensuring that the area is safe to work in. If we are unable to carry out the service due to lack of access, safety concerns, blocked entry, inappropriate behaviour, or other issues beyond our control, we may charge a call-out or cancellation fee.

You are responsible for securing any necessary consents, permits or authorisations for the removal of waste from your premises, for example permissions from landlords, managing agents, neighbours or local authorities if required.

You must ensure that the waste you present for collection is as described in your booking, is accessible, and does not contain any prohibited or hazardous materials unless we have explicitly agreed to handle them and you have complied with all applicable requirements.

Pricing and Quotations

Our pricing is typically based on a combination of factors including volume, weight, type of waste, labour involved, access difficulties, and any disposal or recycling costs. We will provide you with a price estimate before or at the time of booking, based on the information you provide.

If, upon arrival, the actual waste or working conditions differ from what was described, we will reassess the price and inform you before proceeding. If you choose not to proceed with the revised price, we reserve the right to charge a reasonable call-out fee to cover our costs.

All prices are stated in UK currency and may be subject to applicable taxes or charges where required by law. Unless explicitly stated otherwise, quoted prices are exclusive of any additional third-party charges such as special disposal fees for certain types of waste.

Payments and Invoicing

Payment terms will be confirmed to you at the time of booking or prior to the commencement of the service. Unless otherwise agreed in writing, payment is due in full on completion of the service and before our team leaves the site.

We may accept various forms of payment, including cash, card and bank transfer. Accepted payment methods may change from time to time. You agree to provide accurate payment details and authorise us to charge the agreed amount.

For business customers or ongoing contracts, we may agree separate invoicing arrangements. In such cases, payment will be due in accordance with the payment terms specified on the invoice. If payment is not received by the due date, we reserve the right to charge interest on overdue sums at the maximum rate permitted by law and to recover any reasonable costs incurred in pursuing payment.

Cancellations and Rescheduling

You may cancel or reschedule a booking by contacting us directly. To avoid charges, you must give us a reasonable period of notice before the scheduled service time. The required notice period and any applicable fees will be communicated at the time of booking and may depend on the size and nature of the job.

If you cancel with insufficient notice, or if we attend your premises and are unable to complete the service due to circumstances within your control, we may charge a cancellation or call-out fee to cover our time, travel and administrative costs.

We will make reasonable efforts to arrive at the agreed time, but all timings are estimates and may be affected by traffic, weather, previous jobs and other factors beyond our control. If we need to cancel or reschedule a booking, we will notify you as soon as reasonably possible and offer an alternative time. We will not be liable for any loss or inconvenience resulting from such changes, except to the extent required by law.

Waste Types, Prohibited Items and Regulations

We operate in compliance with relevant UK waste management legislation and regulations. All waste we collect is transported and disposed of through lawful and appropriate channels, such as licensed transfer stations and recycling facilities.

You must not present for collection any items that are illegal to possess, transport or dispose of, or that require specialist handling or permits that we have not explicitly agreed to manage. Prohibited or restricted items may include, but are not limited to, certain hazardous materials, clinical or medical waste, asbestos, pressurised containers, flammable liquids, chemicals, gas bottles, and some electrical or electronic equipment that is subject to specific regulations.

If you are unsure whether particular items can be collected, you must consult us in advance. If prohibited or hazardous items are discovered during the service, we may refuse to remove them, adjust the price to reflect additional handling or disposal requirements, or halt the service entirely. You will remain responsible for any such items and any liabilities arising from their presence.

By using our services, you confirm that the waste is your property or that you have the full authority and permission of the owner to dispose of it. You also confirm that the waste does not include stolen goods or any items subject to dispute or legal proceedings.

Customer Cooperation and Conduct

You agree to treat our staff and representatives with respect and to cooperate with any reasonable requests that enable us to carry out the service safely and efficiently. We may withdraw our staff and terminate or suspend a service where we consider that there is a risk to their safety or wellbeing, or where they are subject to harassment, abuse or unreasonable behaviour.

Where our team is required to enter your premises, you must ensure that the environment is safe and that any animals are secured. You must also identify any risks, such as fragile items, unsafe structures, or potential hazards, before work begins.

Liability and Limitations

We will exercise reasonable care and skill in providing our services. However, to the fullest extent permitted by law, our liability to you for any loss or damage arising out of or in connection with the services is limited as follows.

We will not be liable for any loss or damage that is not reasonably foreseeable, indirect or consequential, including loss of profit, loss of business, loss of opportunity or loss of goodwill. We will not be liable for any losses that arise due to inaccurate information provided by you, your failure to comply with these Terms and Conditions, or events beyond our reasonable control.

If any damage occurs to your property as a direct result of our negligence, you must notify us as soon as reasonably possible and in any event within a reasonable timeframe. We may ask for evidence such as photographs and access to inspect the damage. Our liability for such damage will, where legally permitted, be limited to the cost of repair or replacement of the affected area or item, taking account of age, condition and fair wear and tear.

Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Insurance

We maintain insurance cover appropriate to the nature of our waste collection and rubbish removal activities, in accordance with industry practice. Details of our insurance may be made available on request. Our insurance does not replace your own responsibility to maintain appropriate cover for your property and contents.

Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our service, you should contact us as soon as possible with details of your concern. We will investigate the matter and aim to resolve it promptly and fairly.

In the event of a dispute that cannot be resolved directly, both parties agree to consider reasonable attempts at negotiation or alternative dispute resolution before commencing formal legal proceedings, where this is practical and appropriate.

Data Protection and Privacy

We collect and process personal information necessary to provide our services, administer bookings, take payment and communicate with you. We handle such information in accordance with applicable data protection laws in the United Kingdom.

Personal data may include your name, contact details, address, and payment information. We take reasonable steps to keep this information secure and to use it only for legitimate business purposes, such as managing your bookings, improving our services and meeting our legal obligations.

Intellectual Property

Any branding, logos, trade names, written materials and other content supplied by us in connection with the services remain our property or that of our licensors. You may not reproduce, modify or use such materials for any purpose unrelated to your use of our services without our prior written consent.

Variation of Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in our business practices, the services we offer, or applicable laws and regulations. The version of the Terms and Conditions that applies to your booking will be the version in force at the time your booking is confirmed, unless a change is required by law or is made with your consent.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services, except where applicable law does not permit such a restriction.

Entire Agreement

These Terms and Conditions, together with any written confirmation of your booking and any additional terms expressly agreed in writing, constitute the entire agreement between you and Rubbish Removal Chiswick in relation to the provision of our rubbish removal and waste collection services. You acknowledge that you have not relied on any statement, promise or representation not set out in these Terms and Conditions when entering into this agreement.
